Terms and Conditions

ETTP:

• is ETTP Proprietary Limited (“ETTP”), a private company duly incorporated under Property Point Venture Catalysts, in accordance with the company laws of the Republic of South Africa with Registration Number: 2019/130125/08, its registered and physical address situate at 138 West street, Sandown, Sandton, 2196. This is the address where ETTP will accept service of all notices and process.

• You must be 18 years or older to make use of this website and the services, and by doing so you warrant that you are a major.
• The general terms and conditions of the holder(s) of the event(s) and/or the organiser(s) of the event(s) [“promoter”], in addition to ETTP’s terms and conditions, apply.
• These standard terms and conditions apply to all persons making use of the ETTP website and its services. If you do not wish to abide by these terms and conditions, please do not make use of this website/services and do not accept them below.
• Tickets are not replaceable due to damage, loss, theft or any other reason.
• A ticket is void and all rights connected herewith nullified unless purchased from an authorised ETTP sales point or agent.
• ETTP accepts no liability whatsoever arising from the postponement or cancellation of the event(s) and in that regard, any recourse you may have in law is only against the promoter(s), although we provide no representation or undertaking that the promoter(s) will refund you.
• Right of admission to the event(s) is reserved by the promoter(s), and the promoter(s) has the right to alter the programme or the seating thereof. Most venues have restricted items including but not limited to alcohol, weapons, cameras and glass bottles.
• You must separate tickets from one another prior to arriving at the venue.
• By using this website and subscribing to the services, you consent to your personal information being utilised by ETTP and the promoter who may use this information for purposes of liaising with you regarding further offers, provide you with information and/or promotional material.
• ETTP will not pass on your personal information to any third party other than the promoter of the event for which you purchase a ticket(s).
• ETTP may, from time to time, send you advertising material and information, including but not limited to special offers by e-mail, via SMS, WAP Push, newsletters, telephonically, or through other promotional offers.
• Opt-out Clause: If you do not wish to receive offers or information, whether from ETTP or the promoter(s), please notify us by sending an e-mail to info@eTTP.co.za. Due to possible delays, you may still receive promotional material up to 2 months after your notification.
• Ticket cancellations, refunds, exchanges and returns:
  • You may cancel any booking submitted to ETTP for a ticket that has not yet been issued to you at any time prior to the date of the event to which such booking pertains
  • You may also cancel and return any issued ticket acquired through ETTP at any time prior to the scheduled date of the event to which it applies by handing in the ticket at any of our distributions outlets.
  • You must provide us with the relevant booking number. Following receipt of your booking cancellation or returned tickets, we will refund you the face value paid for the relevant ticket (or, if a discounted ticket, then instead the discounted ticket price paid), provided that reasonable cancellation charges as determined by the Promoter may be charged and deducted from such refund. Unless otherwise stipulated by the Promoter and depending on the prevailing circumstances the following cancellation charges may apply:
  • If the cancellation occurs more than 30 days prior to the event, a 15% cancellation fee will apply
  • If the cancellation occurs less than 30, but more than 7 days prior to the event, a 50% cancellation fee will apply;
  • If the cancellation occurs less than 7 days prior to the event a 100% cancellation fee will apply:
  • Notwithstanding the aforesaid, if you can provide us with suitable documentary proof that a person in whose name a ticket was booked will not be able to attend the event because of his/her death and/or hospitalisation, no cancellation fee will apply in respect of the cancellation of such person’s ticket.
  • ETTP and/or a Promoter may refuse admission to events, alter the program or seating arrangements for events, or even postpone or cancel events in certain circumstances. In such case, the Promoter may offer a refund or exchange of tickets for which you may be required to follow certain procedures as determined by the Promoter. No refund will apply if you are refused admission to the event because you are younger than the minimum age for attendance specified by law or you otherwise fail to qualify for attendance. In order to receive any refund or an exchange that is offered, you will have to comply with the Promoter’s instructions and deadlines.
  • Any refunds will be issued using the same method and card of payment that was used to purchase the ticket.

Your Personal Data

• In instances where a Ticket to an event is purchased at an event, you will not necessarily have an online account. In such a case the information we receive from, or regarding you, directly or indirectly through your use of the registration form or card, will only be used by us:
- to administer your wristband/card account, process 
- to carry out our obligations arising from any contracts entered into between you and us; and 
- to monitor and analyse at an aggregated level the organisation of the event and the movements of, and transactions with, attendees
• It is your responsibility to ensure that you have given all the correct details to facilitate this process.

Exclusion from Liability

• The cashless system may be affected by factors outside of ETTP’s or the promoter’s control, such as, but not limited to, system downtime or failure. You understand and agree that ETTP cannot and will not be liable for any direct, indirect or incidental, special, consequential or exemplary damages, including but not limited to damage for loss or profits, goodwill, use, data or other intangible losses resulting from:
  • Failure, malfunction, interruption, errors or unavailability of the cashless system, your equipment, the network, and the cashless service;
  • Viruses that may, despite the reasonable precautions taken, occur on the system;
  • Any error and/or negligence committed by employees of ETTP;
  • Fraudulent falsification of data by third parties’ due to unauthorized intrusion into the system, website or your online account by unauthorised third parties;
  • Your inability to use any service provided by ETTP, directly or indirectly;
  • Unauthorized access to or alteration of your transmission of data;
  • Your failure to give proper or complete instructions relating to your bank account details and/ or your online account;
  • Any fraudulent or illegal use of the wristband or card, the ETTP system and/or your online account; or
  • Your failure to comply with these Terms and any document or information provided by the promoter and/or ETTP concerning the use of wristband or card;
  • Any loss that may arise as a result of any negligence on your part including sharing or exchanging your wristband or card and/or revealing your account details to a third party. For avoidance of doubt, third party means any person other than the registered holder of a ticket and/or wristband/card;
  • Any loss or damage which is caused to you or any third party as a result of your wristband or card getting lost, stolen or damaged, nor for any loss or damage as a result of the use of your wristband or card or online account without your permission or an inaccessibility of your online account
  • All other circumstances not within our control including, without limitation, force majeure, error, interruption, delay or non-availability of the cashless system, unavailability of internet, terrorist or any enemy action, equipment failure, loss of power, adverse weather or atmospheric conditions and failure of any public or private telecommunications system, lack of available resources, strikes or labour disputes
• Subject to subparagraph 23 above, where the services are interfered with or unavailable, ETTP’s  sole liability in terms hereof shall be to re-establish and provide the services as soon as reasonably practicable.
• All warranties and obligations implied by law are hereby expressly excluded to the fullest extent permitted by law.

Indemnity

• By agreeing to be bound by these terms, you agree to indemnify the promoter and ETTP in respect of:
  • All demands, claims, actions, losses and damages of whatever nature which may be brought against the promoter or ETTP arising from the malfunction or failure or unavailability of any hardware, software, or equipment, the loss or destruction of any data, power failures, corruption of storage media, natural phenomena, riots, acts of vandalism, terrorism, any other event beyond the promoter or ETTP’s control, interruption or distortion of communication links or arising from reliance on any person or any incorrect, illegible, incomplete or inaccurate
  • Any loss or damage that may arise from your use, misuse, abuse or possession of any third-party software, including without limitation, any operating system, browser software or any other software packages or programs.
  • Any unauthorized access to your account or any breach of security or any destruction or accessing of your data or any destruction or theft of or damage to any of your device which can be used to access your account.
  • Any loss or damage occasioned by the failure by you to adhere to these Terms and/or by supplying of incorrect information or loss or damage occasioned by the failure or unavailability of third party facilities or systems or the inability of a third party to process a transaction or any loss which may be incurred by the promoter or ETTP as a consequence of any breach of these Terms.

Privacy Policy

• Any information collected by the ETTP website will only be used internally by ETTP and the promoter(s) of the event(s) that you buy tickets for. ETTP and promoter(s) will use your information to send you confirmation of your purchase(s) and information on the event(s) and to compile a generalised profile of the people attending the event(s). ETTP shall not rent, sell or otherwise disclose your personal information to any third party other than the promoter(s) of the event(s) that you buy ticket(s) for without your consent, provided that, by utilising the ETTP website and/or subscribing to any services offered by ETTP and/or the promoter(s), you expressly consent to ETTP utilising your personal information for the purpose of providing the services and for billing and advertising purposes (unless you have opted out) and to other third parties where necessary, or to comply with any law or regulation, to prevent fraud or abuse, misuse or unauthorised use of the ETTP website and to protect ETTP’s rights and those of its customers. ETTP may use your personal information to personalise your profile on ETTP’s internal system. ETTP may receive information about you from reliable third parties and add it to its database purely for ticketing purposes. ETTP shall ensure that such third parties operate a similar ethical policy in relation to your privacy. You may receive invitations to buy tickets for related events or other related products, but you may unsubscribe from these invitations at any time.
• ETTP and promoter(s) will use your information to send you confirmation of your purchase(s) and information on the event(s) and to compile a generalised profile of the people attending the event(s).
• ETTP may receive information about you from reliable third parties and add it to its database purely for ticketing purposes. ETTP shall ensure that such third parties operate a similar ethical policy in relation to your privacy.
• You may receive invitations to buy tickets for related events or other related products, but you may unsubscribe from these invitations at any time.

General:

• You understand that all information (including these rules) relating to the Promotion published on any promotional or advertising material or on the Organisers website at any time before or during the Promotion period will form part of the terms and conditions of entry.
• The Organisers have the right to withdraw or modify the Promotion before the closing date. You will not have any claim against The Organisers in this event.

• It is important that You understand that You and all participants indemnify the Organisers, its directors, affiliates, members, partners, employees, agents, consultants, suppliers, contractors and sponsors against any loss or damages, either direct, indirect, consequential or otherwise, arising from its participation in this Promotion.
• The Organisers will not accept any liability or responsibility for any damage, loss, injury or disappointment suffered by You as a result of participating in the Promotion or accepting any Reward, as the case may be.
• The Organisers will not be liable for any costs incurred by You in claiming a Reward.
• The Organisers may amend, modify or otherwise change these Terms and Conditions in its sole and absolute discretion on notice to You and the amended version will be displayed in the same media as these Terms and Conditions. By participating or continuing to participate in the Promotion, You agree and understand that You will be bound by the amended Terms and Conditions.
• The Organisers are not liable for any technical failures affecting participation and/or Reward redemption process of the Promotion.
• The Organisers assume no liability whatsoever for any entry that has been omitted from participation in the Promotion for any reason whatsoever.
• The Organisers assume no liability whatsoever in the event that Your mobile number was captured incorrectly upon purchase of the Product, the mobile number being a crucial component to the successful delivery of the Reward (via SMS).
• The Organiser has no control over the interception or loss of Your personal information over the internet and assumes no liability for any such interception or loss.
• Any and all costs and expenses associated with Reward acceptance and use not specified herein as being provided, are Your sole responsibility, including any and all government, state and local taxes, insurance and incidental costs.
• You agree that the Organiser and their subsidiaries, as well as their subsidiaries’ advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents will have no liability whatsoever to the fullest extent permitted by law, and will be held harmless by You for any injuries, losses or costs or damage of any kind resulting in whole or in part, directly or indirectly from acceptance, possession, misuse or use of the Reward or parts thereof, or from participation in this Promotion.
• Organisers’ entire liability and Your sole and exclusive remedy will be limited to a distribution of the equivalent amount of Reward as set forth above. By participating in the Promotion, You waive any and all rights to bring any claim or action related to such matters in any forum beyond one (1) month after the first occurrence of the kind of act, event, condition or omission upon which the claim or action is based.
• South African law applies to the operation of the Promotion and the Magistrates court shall have jurisdiction over any and all disputes or claims which may arise from Your participation in this Promotion.
